Zero-Hours and Other Very Atypical Forms of Employment Contracts in European and International Regulation

摘要 Intheefforttodevelopacomprehensiveapproachtobetterandgoodjobs,itisatopicofhotdebateastowhethertheintroduction(temporarilyoronapermanentbasis)ofstatutorylegislation―differentfromthegenerallawapplyingtosubordinateworkers―mayencourageemployersandemployeestooperatewithintheformaleconomyandinthecontextofregularcontractsofemployment.Theessayanalyzesfromacomparativepointofviewnotthetraditionalformsofnon-standardemployment,butthosespecialworkingarrangements,thatmayinvolveveryshorthours(“marginal”parttime:generally,fewerthan15hoursperweek)ornopredictablefixedhours,andthoseaccordingtowhichtheemployerhasnoobligationtoprovideasetnumberofhoursofwork.Theconclusionisthatextremelyatypicalformsofworkappeartogiveananswertothechallengesofthemarketlaboroftheurbaneconomiesofthe21stcentury,butthatspeciallegalprovisionsareneededtoguaranteeindividualrighttofairwagesandtoprotectpersonallifeofemployees.
